TERMS AND CONDITIONS OF SALE – ALLO SIMONNE
Please take a few moments to read and understand these Terms and Conditions of Sale governing the use of the Allo Simonne online store. By using the online shop, you agree to these terms, which apply to all sales made through the website.
1. ORDERS AND ACCESS
You may access the online store via www.allosimonne.com.
By placing an order or using the website, you agree to these Terms and Conditions of Sale.
Customers are encouraged to carefully read these terms before completing any purchase.
2. PRODUCT AVAILABILITY AND INFORMATION
The colours and visuals of products displayed on the website are reproduced as accurately as possible, without any guarantee of perfect accuracy.
Allo Simonne reserves the right to modify, suspend, or remove any product offered on the website without prior notice.
In the event of product unavailability, the item may be out of stock or discontinued. For any questions, you may contact us via the website contact form.
3. RETURNS, REFUNDS AND EXCHANGES
Due to the food nature of our products, all sales are considered final.
Once a transaction has been completed, order cancellations are not possible.
No refunds or exchanges are offered, except at the sole discretion of Allo Simonne or where required by applicable law.
In certain exceptional cases, including but not limited to preparation errors, defective products, or verified quality issues, Allo Simonne may, at its discretion, offer a replacement, credit, or partial or full refund.
When a refund is exceptionally granted, administrative and transaction fees of 3.5% of the refunded amount may be retained.
4. PRICING, TAXES AND PROMOTIONS
Prices are listed in Canadian dollars, before taxes and shipping fees.
Applicable taxes (GST and QST) are calculated according to current regulations.
Shipping fees are calculated based on destination and weight. Standard shipping is typically offered for orders over $100 in Quebec and Ontario, subject to changes and promotions.
Promo codes must be applied before completing the order. No adjustments will be made after purchase.
Allo Simonne reserves the right to modify prices, promotions, and conditions without prior notice.
5. SHIPPING AND DELIVERY
Orders are generally shipped one to two times per week, depending on operational logistics.
Delivery times range from 2 to 5 business days after shipment, depending on the carrier.
If no one is available at the time of delivery, the parcel may be left at a pickup point or returned to the sender according to the carrier’s policies.
Reshipping fees for unclaimed or returned parcels are the responsibility of the customer.
Temperature-Sensitive Products
Although reasonable precautions are taken to protect our products, Allo Simonne cannot guarantee the absence of impacts related to temperature variations or transportation conditions.
Any claim regarding damaged, melted, or broken products must be submitted within twenty-four (24) hours of receipt of the parcel, accompanied by photographs, by email at info@allosimonne.com.
6. PAYMENT
Orders must be paid by credit card through the payment solutions provided on the website.
An order cannot be cancelled once the transaction has been completed.
Administrative and payment processing fees of 3.5% of the refunded amount may be retained.
7. CLAIMS
Any claim related to an order (missing product, preparation error, or any issue not visible upon receipt) must be submitted within a maximum of three (3) days following delivery.
After this period, the order will be considered complete and accepted.
8. MODIFICATIONS TO TERMS
Allo Simonne reserves the right to modify these Terms and Conditions of Sale at any time without prior notice.
The applicable terms are those in effect at the time of the order.
9. FORCE MAJEURE
Allo Simonne shall not be held responsible for any delay, damage, or failure to perform resulting from events beyond its reasonable control, including but not limited to: natural disasters, fires, floods, storms, labour disputes, pandemics, transportation disruptions, shortages, system failures, or any government decision.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Allo Simonne’s liability is limited to the amount paid for the products concerned.
Allo Simonne shall not be held liable for any indirect or consequential damages, including loss of revenue, loss of profits, or loss of opportunity.
11. CUSTOMERS IN THE EUROPEAN UNION
For orders shipped to the European Union, consumers benefit from rights provided under applicable EU legislation.
In accordance with Directive 2011/83/EU, certain food products may be excluded from the right of withdrawal, particularly where they are liable to deteriorate or expire rapidly, or where packaging has been opened, unsealed, or tampered with after delivery for hygiene or health protection reasons.
Where the right of withdrawal applies, the customer has fourteen (14) days from receipt of the order to exercise it.
Return shipping costs are entirely the responsibility of the customer. The customer is responsible for arranging the return of products to the address provided by Allo Simonne in Quebec, Canada.
Returned products must be unopened, unused, and in their original packaging, in a condition suitable for resale.
Any eligible refund will be processed after receipt and inspection of the returned products.
